GENERAL TERMS & CONDITIONS FOR CLASSES/EVENTS/WORKSHOPS
1. INTRODUCTION
a. Circability is engaged in the business of providing circus programmes and activities.
b. The Participant wishes to engage with Circability activities, signing up/registering/enrolling for a specific class, event or workshop as selected by the participant.
2. CIRCABILITY OBLIGATIONS
a. Circability shall provide the class/event/workshop as described in the selected class/event/workshop option.
b. Circability shall ensure that the tutors:
i. attend the class/event/workshop punctually at the times arranged except in the cases of accident or illness when Circability will notify the Client as soon as reasonably possible; and
ii. perform to the best of their ability and professional skill; and
iii. will not render any services while affected by alcohol or drugs nor consume any alcohol, drugs, cigarettes or vapes while at the event.
iiii. are fully vetted prior the start of the class/event/workshop
c. In the event that any of the tutors are unable to perform at the event, Circability will endeavor to give the client no less than 48 hours notice, and will suggest alternative tutors. If the client does not wish to have those alternative tutors perform at the class/event, they shall be entitled to cancel this agreement without payment of the fee.
d. Circability will be responsible for any personal or public liability insurance and ACC cover which it considers appropriate.
3. PARTICIPANT OBLIGATIONS
a. Participants shall:
i. attend class/event/workshop punctually at the times arranged except in the cases of accident or illness when the participant will notify Circability as soon as reasonably possible; and
ii. perform to the best of his/her behavior; and
iii. will not participate whilst affected by alcohol or drugs and not consume any alcohol, drugs, cigarettes or vapes while at the class/event/workshop.
b. In the event that participants are unable to attend the class/event/workshop, participants are asked to endeavor to give no less than 24 hours notice.
4. PAYMENTS & FEES
a. The client agrees to pay the total fee on the date indicated on the invoice.
b. An invoice will be issued and sent to the name and details provided in the form
c. In the event of cancellation of the event or the services under this agreement by the client (for reasons other than set out in clause 2c), if the client informs Circability less than 24 hours (one day) prior to the class start time Circability will retain the full fee.
5. HEALTH & SAFETY
Circability provides a safe working environment for the tutors and will inform participants of all potential risks to the health or safety of the participants.
Circability holds a current Risk and Management Form (RAMS) for the activities and runs the activities according to the safe standards in this form. To consult Circability’s most recent version please contact office@circability.org.nz
The Client shall provide information about participants with any conditions (namely infectious diseases) we need to be aware of when taking part in our classes.
6. PHOTOGRAPHY FOR PROMOTIONAL MATERIAL
Photos taken in the classes, workshops and performances may be used for marketing and promotional purposes. Please let us know if you wish not to have the participant’s photos used.
7. TERMINATION
Seven days notice is required for termination of class enrollments. Circability reserves the right to retain class fee if student registration is cancelled within seven days.
